This application does not conform to the City Council approved Mimico-Judson Secondary Plan (June 7, 2016).

39 Newcastle lands are owned by Dunpar (CIC Management). Dunpar also own lands at: 101 Portland Street, 50 Windsor Street, 49, 53, 55 Judson Street and have an interest in 29 Judson Street.

All these properties are part of three separate appeals of the Mimico-Judson Secondary Plan to the Ontario Municipal Board (OMB). Dunpar has also appealed 21, 23, 25 and 31 Windsor Street, 18 Buckingham Street and 66 Newcastle Street to the OMB.

Eleven appeals have been filed to the Ontario Municipal Board (OMB) citing various objections regarding the approved Secondary Plan. Dunpar is responsible for four of the eleven appeals. The lawyer representing all four appeals at the OMB is Mary-Flynn Guglietti, McMillan and the Planning Consultants are LouisTinker and Peter Smith (also representing Freed Development), Bousfields.
The application for 39 Newcastle Street was submitted to city planning staff on July 29, 2016 and declared complete on August 23rd, 2016. In a 120 days from this date, the application could also be appealed to the OMB and the lawyers may ask the Board to hear this appeal at the same time as their Mimico-Judson Secondary Plan appeal, saving time and money.
